PART II - CREATION OF WAKAF

Section 10. Restrictions on wakaf khas.

A wakaf khas made after the commencement of this Enactment shall be null and void unless—

(a) the Yang di-Pertuan Agong, on the advice of Majlis, has expressly sanctioned and validated the same; or

(b) it has been made by the waqif while he is in a state of marad-al-maut and subsequently dies due to the illness and provided that it has been made by way of sighah before two witnesses.
