PART XIII - SETTLEEMNT, WITHDRAWAL AND DISCONTINUANCE
Section 96. Withdrawal.
(1) The plaintiff may on such terms, at any time before judgment with leave of the Court, withdraw any proceedings wholly or in part by giving notice in Form MS 18 to the Court and serve a copy thereof to the defendant and all other parties in the proceedings.
(2) Where the plaintiff withdraws any proceedings under subsection (1), the defendant is entitled to the costs of the proceedings at the discretion of the Judge.
