Section 28. Pardon
A wali may at any time before the execution of the punishment of death as the qisas punishment, pardon the offender either with or without a diyat; and if the pardon is with a diyat, this shall be paid either in a lump sum or by installment within a period of three years from the date of the final judgement, and if in the meantime the offender dies, the diyat shall be recoverable from his estate. In case of no estate available the diyat is borne by Baitulmal.
