PART VII - OFFENCES



Section 192. Khalwat.

(1) Any man who is found co-residing or cohabiting, or in seclusion or concealment, or courting with,
or in close and suspicious proximity in any place to,
any woman, whether or not the woman is a Muslim,
other than his lawful wife according to Hukum Syara'
or a woman who, by reason of consanguinity, affinity,
or fosterage, he is forbidden by Hukum Syara' to marry, commits the offence of khalwat and shall be punished
with a fine not exceeding three thousand ringgit or with imprisonment not exceeding one year or with both.

(2) Any woman who is found co-residing or cohabiting,or in seclusion or concealment, or courting with, or in close and suspicious proximity in any place to, any man, whether or not the man is a Muslim, other than her lawful husband according to Hukum Syara' or a man who, by reason of consanguinity, affinity, or fosterage, she is forbidden by Hukum Syara' to marry, commits the offence of khalwat and shall be punished with a fine not exceeding three thousand ringgit or with imprisonment not exceeding one year or with both,

(3) The Court may, if it ,thinks fit, order that any woman convicted of an offence under this section be committed to a welfare home proved by the Department for purposes of rehabilitation for a period not exceeding six months.
