(1) In this Enactment, unless the context otherwise requires -
"Administration Enactment" means the Administration of Islamic Law Enactment 1992 (En 2/92);
"bailiff" in cludes Registrar or any officer of the Court charged with Performing the duties of a bailiff;
"certified translation" means a translation of any document certified as correct by an officer of the Court or, by any other person as may be accepted by the Court;
"Court" or "Syariah Court" has the same meaning assigned thereto in the Administration Enactment and includes a Judge of any Court;
"domicile" means permanently residing or habitually residing in a dwelling house in a particular area;
"Form" means a form set out in the First Schedule, and a form referred to by a number means the form so numbered in that Schedule;
"Government" means the Government of any State in the Federation inlcuding the Federal Government;
"Hukum Syara'" means Islamic Law according to Mazhab Shafie or any other Mazhab that is recognised;
"judgment" includes grounds of judgment;
"judgment debtor" means a person liable under any judgment for payment of money;
"judgment creditor" means a person having the right to enforce judgment for payment of money either by instalment or otherwise;
"lien" means a right on the property of a judgment debtor to the extent of the indebtness;
"Majlis" means Majlis Agama Islam dan 'Adat Melayu Perak established under section 4(1) of the Administration Enactment;
"minor" means a person who has not attained the age of 18 years;
"notice' means written notice unless the Court in any case shall order otherwise;
"peguam syarie" has the same meaning assigned thereto in the Administration Enactment;
"person of unsound mind" means an unsound person according to Hukum Syara' or has the meaning as assigned thereto in the Mental Disorders Ordinance 1952.
"person under disability" includes a minor, a person of unsound mind and a person prohibited from administering his property;
"property" means moveable or immoveable property and inlcudes intellectual property;
"Registrar" includes the Chief Registrar and Assistant Registrar appointed under section 43 of the Administration Enactment;
"residing" means temporarily residing in a particular place;
(2) All words and expressions used in this Enactment and not herein defined but defined in the Interpretation Act 1948 and 1967 shall have the meaning assigned thereto respectively in the Act in so far that it does not conflict with Hukum Syara'.
