PART VI - HADHANAH OR CUSTODY OF CHILDREN
Section 71. Qualifications for right of custody.
Hadhinah that is a woman, who has the right of is entitled to exercise her rights of custody if-
(a) she is a Muslim; custody.
(b) she is of sound mind;
(c) she is of sufficient maturity to give the children the care and love that they need; and
(d) she is of good character as a Muslim;
(e) she lives in a place which will not cause the children to suffer any harm to their character or physical well-being.
