Section 72. Duration of hadhanah.

(1) The right of a hadhinah to look after a child shall end when the child reaches the age of seven, if the child is a male, and the age of nine if the child is a female:

Provided a Court may on the application of a hadhinah allows the child to be looked after by her until the child attains the age of nine if he is a male and attains the age of eleven if she is a female.

(2) After the age mentioned in sub-section (1) the hadhanah shall vest in the father and if the child reaches the age of mumaiyiz the child shall be entitled to elect to stay either with the mother or father unless the Court otherwise orders.
