PART VI - SPECIAL PROVISIONS CHAPTER 21 - PROCEEDINGS IN CASES OF CERTAIN OFFENCES AFFECTING THE ADMINISTRATION OF JUSTICE
Section 173. Alternative procedure.
If the Court, in any case, considers that a person accused of an offence referred to in section 171 and committed in its view or presence may be better dealt with by ordinary process of law, such Court, after recording the facts constituting the offence and the statement of the accused as hereinbefore provided, may direct the accused to
be prosecuted, and may require security to be given for the appearance of the accused before a Syariah Judge or, if sufficient security is not given, may forward the accused under custody to another Syariah Judge for trial.
