PART V- PROSECUTION AND REPRESENTATION

Section 78. Chief Syarie Prosecutor and Syarie Prosecutors.

(1) The Duli Yang Maha Mulia Raja Pemerintah after consulting the Majlis, may appoint a person who is qualified to be a Judge of the Syariah High Court to be the Chief Syarie Prosecutor.

(2) The Chief Syarie Prosecutor shall have power exercisable at his discretion to institute, conduct or discontinue any proceeding for an offence before any Syariah Court.

(3) The Majlis, may appoint fit and proper from amongst the members of the State public service of Perlis to be Syarie Prosecutors.

(4) Syarie Prosecutors shall act under the general control and direction of the Chief Syarie Prosecutor and may exercisable by the Chief Syarie Prosecutor, except rights and powers expressed to be exercisable by the Chief Syarie Prosecutor personally.
