Section 23. Abatment of action

In the case at the marriage, death or bankruptcy of any party-

(a)

if the cause of action does not survive, the proceedings shall abate, save as provided in paragraph

(c)

(b)

if the cause of action survives or continues, the proceedings shall not abate or become defective ;

(c)

in case of death after the conclusion of the trial but before judgement is delivered or entered, the proceedings shall not abate, and judgment may be delivered and entered.
