PART XV - WITHDRAWAL AND SETTLEMENT
Section 93. Effect on future proceedings.
Withdrawal shall afford a defence by way of
res judicata
for subsequent proceedings unless-
(a)
if occurred before the filing of the defence, or if no defence is filed, before the trial of the proceedings, or
(b)
the Court has granted leave to institute fresh proceedings.
