Section 193. Non-appearance of parties.

(1) Where any party to an application fails to attend the hearing of his application, the Court may strike out the application.

(2) Where any party to an application fails to attend on the first or any resumed hearing of the application, and the Court thinks it expedient to proceed with the hearing in the absence of any party, it may do so.

(3) Before proceed with the hearing in the absence of any party, the Court shall be satisfied that the application or the notice of the time appointed for the resumed hearing was duly served on that party.

(4) Where the application had been struck out without hearing by reason of the failure of the applicant to attend, the Court may, if satisfied that it is just to do so, allows the application to be reinstated.

(5) Where the Court hearing an application proceeds in the absence of a party, then, provided that any order made on the hearing has not been perfected, the Court, if satisfied that it is just to do so may rehear the application.
