PART VII - OFFENCES

Section 188. Failure to attend Friday prayers.

(1) Every mukallaf who in the absence of any keuzuran syar'i, fails to attend Friday prayers at a mosque where Friday prayers may be held commits an offence and shall be punished with a fine not exceeding one thousand ringgit or with imprisonment not exceeding six months or with both.

(2) Keuzuran syar'i exists for a person if-

(a)

his attendance is prevented by heavy rain; or

(b)

his place of residence, by the shortest route, is more than 3.2 kilometre from any mosque; or

(c)

less than forty

mukallaf,

or such number as His Royal Highness the Sultan may prescribe as adequate for the performance of Friday prayer, reside in the

mukim masjid

in which he then is; or

(d)

he is ill or is not resident in the

mukim masjid

in which he then is; or

(e)

there are other circumstances approved by Hukum Syara'.
