Section 71. How the right to hadhanah to forfeited.

The right to hadhanah shall be forfeited-

(a) if the female person is married to a male person who is not affiliated to the child:

Provided the right to hadhanah shall be restored to her if the marriage is dissolved;

(b) if the female person is openly or excessively of bad character;

(c) if she changes her domicile with the view to preventing the father of the child from giving the necessary supervision over the child:

Provided a divorcee may take hadhanah of the child to her place of birth;

(d) if she becomes an apostate; or

(e) if the female person has neglected or is cruel to the child.
