PART II - OFFENCES
Section 24. Takfir
(1) Any person who utters or implies by words, either spoken or written or by signs, or by visible representations, or by any act, activity or conduct or by organising, prompting or arranging any activity, or otherwise in any other manner that any person professing Islamic Religion or persons in group, class or description of person professing Islamic Religion-
(i) is a non-Muslim, or
(ii) has ceased to profess that religion, or
(iii) should not be accepted, or cannot be accepted, as professing the Islamic Religion, or
(iv) does not believe, follow, profess or belong to the Islamic Religion,
shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding three years or to a fine not exceeding five thousand ringgit or to both:
Provided that this section shall not be applied to –
(a) anything done by religious authority established, constituted or appointed by or under any written law and conferred by any written law with power to give or issue any fatwa or decision or any matter pertaining to with the Islamic Religion;
(b) anything done by any person which is pursuance of or which accord with, any fatwa or decision given or issued by such religious authority, whether or not such fatwa or decision is in writing, and if in writing, whether or not it is published in the Gazette.
(2) Any person who interprets wrongly any fatwa issued by religious authority shall be guilty of an offence and shall be liable, on conviction, to imprisonment for a term not exceeding three years or to a fine not exceeding five thousand ringgit or to both.
