Section 38. Retiring solicitor refusing to sign.

If a solicitor refuses to sign a memorendum in Form 4 or Form 5 the Court may on application order him to do so. On any such application the Court shall have regard to any claim to lien or to a charging order. The costs of the application shall be in the discretion of the Court.
