Section 102. Conditions requisite for a valid declaration.
When a male person declares another either expressly or impliedly as his lawful child, he shall be deemed to be the father of that child in the following circumstances-
(i) there is no one else who is presumed to be the father of that child;
(ii) the difference in the ages of the male person who declares the child and the child shows a probable relationship between a father and a child;
(iii) if the child has attained puberty and able to make his own decision that child shall consent to the fact that he has been declared as the son
of that person;
(iv) that the male person and the child's mother could cohabit lawfully in'marriage at the time of gestation;
(v) that the declaration is unequivocal that the child is his lawful child;
(vi) that the declarant has the capacity to make the declaration under Hukum Syarak; and
