ENACTMENT NO. 1 OF 1983 ISLAMIC FAMILY LAW ENACTMENT 1983
PART III - MARRIAGE AND REGISTRATION
Section 20. Solemnisation of marriages in Malaysian Embassies, etc., outside Malaysia.
(1) A marriage may be solemnised according to Hukum Syarak by the Registrar appointed under subsection (4) of section 6 under this Enactment at the Malaysian Embassy, High Commission or Consulate in any country which has not notified the Government of Malaysia of its objection to solemnisation of marriages at such Malaysian Embassy, 'High Commission or Consulate:
Provided that the Registrar shall be satisfied-
(a) that one or both the parties to the marriage is domiciled or is temporarily resident in this State;
(b) that each party has the capacity to marry according to the provisions of Hukum Syarak and this Enactment; and
(c) that, where either party is not domiciled or is not temporarily resident in this State, the proposed marriage, if solemnised, is valid in the country where such party is domiciled,
(2) The procedure for the solemnisation and registration of marriages under this section shall be similar in all respects to that which applies to marriages solemnisedand registered in this State under this Enactment.
