Section 58. Power to examine the records of the Syar'iah High Court and the Syar'iah Subordinate Courts.

(1) The Syar'iah Appeal Court or the Syar'iah High Court, as the case may be, may call for and examine the records of any proceedings in a criminal matter before the Syar'iah High Court or a Syar'iah Subordinate Court, as the case may be, for the purpose of satisfying itself that the decision in the proceedings is correct and valid, and that the proceeings were carried out in accordance with the rules of the Court.

(2) Notwithstanding Subection (1), the Commissioner may request for copies of the records of any original proceedings in a criminal matter before the Syar'iah High Court or a Syar'iah Subordinate Court, and if he is of the opinion that the decision reached was not in accordance with law, he may refer the matter to the Syar'iah Appeal Court or the Syar'iah High Court, as the case may be, and the appropriate Court may call for and examine the records of the proceedings.
