ENACTMENT NO. 2 OF 1992 ADMINISTRATION OF ISLAMIC LAW ENACTMENT 1992
PART III - MUFTI AND THE SYARIAH COMMITTEE
Section 37. The Syariah Committee.
(1) There shall be a committee to be knwon as the Syariah Committee.
(2) The Committee shall consist of -
(a) the Mufti, as Chairman;
(b) the Timbalan Mufti, if any;
(c) two members of the Majlis learned in Hukum Syara', appointed by the Majlis;
(d) a fit and proper officer from the Jabatan Agama Islam Perak to be niminated by its Head of Department;
(e) at least two but not more than five persons well versed in Hukum Syara' to be appiointed by the Majlis.
(3) The persons who, immediatelty before the commencement of this section, weere appointed members of the Syariah Committee under the 1965 Enactment shall continue to be members of the Committee until the expiry of their current period of appointment.
(4) Wherenever the Mufti proposes to make a fatwa under section 34 or to amend, modify or revoke a fatwa under section 36 he shall call a meeting of the Committee for the purpose of discussing the proposed fatwa.
(5) Before the Mufti makes, amend, modify or revoke a fatwa, he may direct a study or research to be conducted and a working paper prepared.
