ADMINISTRATION OF ISLAMIC RELIGIOUS AFFAIRS ENACTMENT OF THE STATE OF PENANG 1993

PART 1 - PRELIMINARY

Section 2. Interpretation

(1) In this Enactment, unless the context otherwise requires -

"anak Qaryah"means a person who is permanently or habitually resident in the Qaryah masjid;

"Baitumal" means the Baitulmalof the Majlis Agama Islam Pulau Pinang established under section 90;

"Chief Syariah Judge" means the Chief Syariah Judge appointed under section 43(1);

"Committee" means a Board or Committee established under section 5;

"Court" or "Syariah Court" means the Syariah Subordinate Court, the Syariah High Court, or the Syariah Appeal Court, as the case may be, constituted under section 42;

"Enactment" means the Administrations of Islamic Religious Affairs Enactment of the State of Penang 1993;

"Imam Rawatib"means an Imamchosen by the anak Qaryahof a mosque and approved by Majlis;

"Islamic Law" means Islamic Law in any Mazhabrecognised by the Syariah Committee;

"Jawatankuasa Qaryah"means a Jawatankuasa Qaryahestablished under section 73 (1);

"Judge or Syariah Judge" means Judges of the Syariah High Court appointed under section 45 (1) but does not include a Judge of the Syariah Subordinate Courts appointed under section 46 (1);

"Majlis" means the Majlis Agama Islam Negeri Pulau Pinang established under section 4;

"Mosque" means a building used for holding Friday and other prayers and activities enjoined, recommended or approved by the religion of Islam, and includes suraulisted in the record of the Majlis;

"Mufti" means the person appointed to be the Mufti Kerajaan Negeri Pulau Pinang under section 34;

"Muslim" means -

(a) a person who professes the religion of Islam:

(b) a person whose parents were Muslims, or one of whose parents who has the right of custody of the person was a Muslim at the time of the person's birth;

(d) a person who has converted to Islam in accordance with section 78 or under section 80;

(e) a person who is commonly reputed to be a Muslim; or

(f) a person who is shown to have stated, in circumstances in which he was bound by law to state the truth, that he was a Muslim, whether the statemant be verbal or written.

"Officers of the Court" includes Chief Syariah Judge, Syariah Judges including Judges of the Syariah Subordinate Courts, Chief Registrar, Registrar, Assisstant Registrar, Clerk and Process Server;

"Pegawai Masjid"includes the Naqib Masjid, Imam Rawatib, Imam, Khatib, Pembantu Khatib, Bilaland Pembantu Bilalof a mosque;

"Peguam Syarie"means a person appointed as a Peguam Syarieunder section 63;

"Qaryah Masjid"or "Qaryah"means the area or boundaries which are determined under section 67 in which the mosque is situated;

"Registrar of Conversion" means the officers appointed under section 89;

"Religious Enforcement Officer" means the officers appointed under section 62;

"Religious Officer" means officer of the Islamic Religious Department of the State of Penang and includes Religious Enforcement Officer and Pegawai Masjid;

"Secretary" means the Secretary of the Majlis appointed under section 11;

"Syariah Prosecutor" means an officer appointed under section 61 and includes Chief Syariah Prosecuter;

"Yang di - Pertua" means the Yang di - Pertua of the majlis.

(2) All words and expressions used in this Enactment and not herein defined but defined in the Interpretation Acts, 1948 and 1967 (Act 388)shall have the meaning thereby assigned to them respectively to the extent that such meanings do not conflict with Islamic Law,

(3) For the avoidance of doubt as to the identity or interpretation of the words and expressions used in this Enactment that are listed in the Arabic script for those words and be made expressions as shown against them therein.
