PART XXIII - CONTEMPT OF COURT



Section 219. Notice to show cause.

(1) The Court shall have the jurisdiction to take action or proceedings against any person who commits contempt of Court and in that proceedings the Court may make against such person an order of committal not exceeding 6 months or may impose a fine not exceeding RM2000.

(2) The Court may, on the application of any party to any cause or matter or on its own motion, issue a notice to show cause.

(3) No application to a Court for issuance of a notice to show cause against any person may be made unless leave to do so is given in accordance with this Part.

(4) An application for leave shall be supported by an affidavit stating the name and particulars of the person against whom the notice to show cause is to be issued and the grounds of the application.

(5) If a person commits a contempt before the Court, it shall not be necessary for the Court to serve the notice to show cause but the Court shall ensure that the person understands the nature of the offence alleged against him and has the opportunity to be heard in his own defence, and the Court shall record the proceedings.

(6) In all cases of contempt of Court, the notice to show cause why an action or proceedings shall not be taken shall be served on the person alleged to have committed the said contempt.

(7) An order of committal shall be in Form MS 54.
