Procedure in Civil Proceedings

Section 121. Statement of claim.

(1) All civil proceedings in a Syar'iah Court shall be brought by filing a statement of claim or by making an oral complaint in the Court, and in either case by paying the prescribed fee.

(2) In the case of an oral complaint, the Court shall draft the statement of claim for the plaintiff, which shall be signed and filed by him.

(3) The statement of claim shall contain the names, addresses, and descriptions of the parties, a concise statement of the cause of action, without argument or unnecessary detail, and a statement of the relief claimed or judgment prayed for.
