Section 45. Presumption of death.

(1) If a husband or a wife is believed dead the Court may on the application of the husband or wife and after whatever due investigation issue in the form prescribed a certificate presuming the husband or wife dead and subsequent to that the husband or wife is free to marry again under the provisions of this Enactment and the certificate relating to a husband shall be deemed to be a certificate of death within the meaning of section 11 (3) (b).

(2) The certificate issued under sub-section (1) shall be registered as if the certificate is a certificate of divorce and shall be entered in the relevant register.
