Section 222. Appearance of the moon.

(1) It shall be the duty of the Chief Qadi every month to make inquiry so as to determine the day on which the new moon of the following month may be seen and to make inquiry, on the day so determined, as to whether or not the new moon in fact appeared and then tocertify under his hand the result to his inquiry.

(2) The Chief Qadi shall then forthwith transmit the information mentioned in subsection (1) to the Commissioner for transmission to His Royal Highness the Sultan.

(3) It shall be an irrebuttable presumption of law that the new moon in question was seen on the date certified by the Chief Qadi.
