PART III - PRODUCTION AND EFFECT OF EVIDENCE CHAPTER 7 - WITNESSES
Section 86. Number of witnesses
(1) Evidence in a case of zinawhich carries a penalty of hududis inadmissible except where it was witnesseth by four male witnesses.
(2) A claim made by a person known to be rich that he has become a pauper is inadmissible unless it is
corroborated by three male witnesses.
Explanation- Admission of being a pauper in the collection of zakatand of being a pauper which relinguishes the burden of repaying debts and maintenances of family and wife is inadmissible unless it was witnesseth by three male witnesses.
(3) Inthe matter of sighting the moon, the evidence of one male witness who is adilis admissible.
(4) Evidence of a male person in the following circumstances.
(a) evidence of a teacher a case involving school children;
(b) evidence of an expert in the valuation of defective goods;
(c) evidence of approving and rejecting witnesses;
(d) notification concerning the dismissal of a representative;
(e) notification concerning shoddy goods, is admissible.
(5) Evidence of a female is admissible in matters which are usually seen by women.
ILLUSTRATIONS
Evidence of a woman who breast-feeds a child, a midwife in matters relating to menstruation, birth, breast-feeding and immorality of a woman is admissible.
(6) In other matters other than those mentioned above evidence shall be given by two male or one male and two female witnesses.
