ENACTMENT NO 5 OF 2005 WAKAF (STATE OF MALACCA) ENACTMENT 2005
PART IX - GENERAL
Section 45. Offences on wakaf land.
(1) Any person who without the permission of the Majlis—
(a) occupies or erects any building or any structure on any wakaf land; or
(b) clears, ploughs, digs, encloses, cultivates on any such wakaf land or part thereof; or
(c) cuts, picks or removes any produce on or from the wakaf land,
commits an offence and upon conviction may be liable to fine not exceeding five thousand ringgit or imprisonment not exceeding three years or both, and for continuing offence, fine not exceeding five hundred ringgit for each day during which the offence is continued.
(2) A person who is convicted for the offence under paragraph 45(1)(a) shall, if ordered by the Majlis, demolish, destroy or clear all structures and obstructions on the wakaf land on his own expenses.
(3) Where the person mentioned under subsection (2) fails to obey the directions of the Majlis under the subsection mentioned, the Majlis may cause it to be demolished,destroyed and cleared of all structures and obstructions on that wakaf land and claim the necessary costs from that person.
(4) A person who is convicted for the offence under paragraph 45(1)(b) or (c) shall, if the Majlis directs, to pay damages or compensations as determined by the Majlis.
