PART III - MAWQUF-ALAIH

Section 12. When the usufruct or benefit of mawquf to be shared equally, etc.

(1) Where there is more than one mawquf-alaih and the waqif has not determined their respective proportion to the usufruct or benefit of the mawquf, it shall be distributed equally amongst them.

(2) Section 11 shall apply to the usufruct or benefit of any of the mawquf-alaih as mentioned under subsection (1) of this section who is dead or cannot be traced without the need for any notification in the Gazette.

(3) Where a wakaf is made to asnaf zakat without determining their respective share, the usufruct or benefit from the mawquf shall be divided in accordance to the proportion of asnaf zakat.
