Process To Compel Appearance (Civil Cases)



Section 90. Substituted service.

(1) Where the Court is satisfied that a party who has given no address for service was, at the date when the summons or other document was issued, resident in the State and there is reason to believe that he is keeping out of the way for the purpose of avoiding service of the summons or other document or that there are sufficient reasons why the summons or other document cannot be served in the ordinary way, the Court may order the summons or other document to be served by affixing a copy thereof in some conspicuous place in the Court building and also on some conspicuous part of the house where the person named in the summons or other document is known to have last resided, or in any other manner that the Court thinks fit.
(2) The Court may also, in any case falling within the terms of subsectIon (1), make an order for servIce by advertisement in any local newspaper that the Court thinks fit.

(3) Substituted service shall be as effectual in law as personal service.

(4) In cases of substituted service, the Court, where it is necessary, shall fix the time for the appearance of the party to be served.
(5) No order for substituted service shall be made in respect of-
