PART III - MUFTI AND THE SYARIAH COMMITTEE



Section 34. Fatwa.

(1) Subject to section 27(4), the Mufti may, on his own initiative or on a written request of any person make a fatwa or give a ruling on any unsetteled or controversial question of or relating to Hukum Syara'.

(2) No statement made by the Mufti shall be taken to be a fatwa unless and until it is on the direction of Duli Yang Maha MUlia Sultan publiched in the Gazette.

(3) Upon publication in the Gazette, a fatwa shall be binding on every Muslim resident in the State of Perak Darul Ridzuan as a dictate of his religion and it shall be his religious duty to abide by and uphold the fatwa, unless he is permitted by HUkum Syara' to depart from the fatwa in matters of personal observance, belief, or opinion.

(4) A fatwa shall be recognized by all Syariah Courts and civil courts in the State of Perak Darul Ridzuan as authoritative of all matters laid down therein. In the event there are differences in fatwa on the same matter, the fatwa issued later shall prevail.
