PART XXVII - DISTRESS



Section 199. Powers of bailiff.

In executing a warrant of distress, the bailiff shall, as regards property subject thereto, and subject to any written law, have the like rights, powers and duties as if the warrant were an order for execution :

Provided that nothing in this section shall affect any question of priorities :

Provided futher that on any sale under a warrant of distress the bailiff shall not sell more property than is necessary to satisfy the distress, expenses, fees, commission and costs, notwithstanding that any order for execution may be in his hands, but he may after the sale seize under such order any property subject thereto which would otherwise have been released, or the proceeds of sale of any such property which would otherwise have been paid to the judgment debtor.
