Procedure in Criminal Proceedings
Section 107. Arrest without warrant.
(1) Notwithstanding any other police written law, any police officer or any Syar'iah Enforcement Officer may arrest without warrant-
(a) any person who commits or attempts to commit in his presence any offence under section 192 or 193;
(b) any person who commits in his presence any offence under this Enactment and, " when requested, refuses or fails to give his name or address or gives a name or address which is believed to be false;
(c) any person against whom a warrant under this Enactment has been issued and is still in force, although the warrant is not in the possession of the person arresting him.
(2) No person empowered to arrest under subsection (1) shall release any person arrested by him unless he has executed a bond to appear before the Court when required.
(3) Where a person arrested without a warrant is not released under subsection (2), he shall, without delay and in any event within twenty-four hours from the time of his arrest, not including the time necessary for the journey, be produced before the Court.
(4) Where a person is produced before the Court, the Court may either require the person to execute a bond, with or without sureties, for his appearance before the Court when required, or may remand him in custody by a warrant issued by the Court in the prescribed form pending trial.
