Section 55. Fixing of the date of hearing of the appeal.

(1) The Syar'iah High Court shall then fix the date for hearing of the appeal and shall notify the parties of the date when and the place where the appeal shall be heard.

(2) On the date fixed, or on any other date to which the hearing of the appeal ay be adjourned, the Syar'iah High Court shall hear the parties to the appeal and shall then make such order in accordance with subsection (3) and with regard to the costs of the appeal as it considers appropriate.

(3) On any appeal the Syar'iah High Court may confirm, reverse, or vary the decision of the trial Court, exercise any such powers as the trial Court could have exercised, make such order as the trial Court ought to have made, or order a retrial.

(4) No appeal shall be allowed or a retrial ordered on grounds of irregularity of procedure or wrongful admission of evidence unless a failure of justice has been occasioned thereby.
