Section 92. Manner of giving evidence.

(1)In civil cases evidence shall be given by the plaintiff and the defendant. The defendant who denies the claim may be asked to take the oath according to Hukum Syara'.

(2) (a) When the defendant takes the oath, the plaintiff's claim is rejected in toto.

(b) If the defendant is asked and refuses to take the oath, the Court may ask the plaintiff to take the oath and after taking such oath his claim shall be accepted.

(3) In criminal cases, evidence shall be given for the prosecution and for the accused except when the accused pleads guilty.
