Procedure in Criminal Proceedings



Section 105. Power to require attendance of witnesses.

(1) A Syar'iah Enforcement Officer making an investigation under this Enactment may by order in writing require the attendance before himself of any person who appears to the officer to be acquainted with the circumstances of the case, and such person shall attend as so required.

(2) If any person subject to an order under subsection (1) fails to attend as required by the order, the Syar'iah Enforcement Officer may report the failure to a Qadi who may thereupon issue a warrant to secure the attendance of the person asrequired by the order.

(3) A person attending as required under subsection (1) shall be entitled to be paid the reasonable travelling and subsistence expenses incurred by him.
