Section 98. Recognition of marriage solemnized in the Embassies etc. in Malaysia.
(1) A marriage of a Muslim who is not a citizen of Malaysia solemnized in any Embassy, High Commission, or Consulate of a foreign country in this country
shall be recognised as valid and as a marriage registered under this Enactment if-
(a) the marriage was solemnized according to the procedure as required or allowed by the law of the Embassy, High Commission or Consulate or according to the procedure allowed by this Enactment;
(b) each party has the capacity at the time of the marriage to contract the marriage according to his lex domicilii; and
(c) if one of the party is a domicil or resident of not less than four months in this State and both of them has the capacity to marry.
(2) Notwithstanding the provision of sub-section (1) a marriage of a Muslim so solemnized above shall not be registered under this Enactment if the marriage is in contravention of the provisions of section 17.
