Section 40. Setting down appeals on list.

(1) If the Syar'iah High Court does not reject an appeal summarily, it shan fix the number of the appeal and enter it on the list of appeals to be heard and give notice to the parties concerned that the appeal has been registered.

(2) As soon as the date of hearing has been fixed, the Syar'iah High Court shall give notice to the parties concerned of the date of hearing of the appeal.

(3) In any case the Syar'iah High Court may, on its own motion or on the application of any party and with reasonable notice to the parties concerned, advance or postpone the date of hearing of the appeal.
