PART V - PROSECUTION, ENFORCEMENT AND REPRESENTATION

Section 61. Syariah Prosecutors

(1) The Yang di - Pertuan Agong may, advice of the Majlis, appoint a person who is qualified to be a Judge of the Syariah High Court, to be the Chief Syariah Prosecutor.

(2) The Chief Syariah Prosecutor shall have power exercisable at his discretion to institute, conduct or discontinue any proceedings for an offence before a Syariah Court.

(3) The Majlis on the advice of the Chief Syariah Prosecutor may appoint fit and proper persons from among the members of the general public service of the Federation or the State of Penang to be the
Syariah Prosecutors who shall act under the general control and direction of the Chief Syariah Prosecutor and may exercise all or any of the rights and powers. vested in or exercisable by the Chief Syariah Prosecutor under any written law except any rights or powers expressed to be exercisable by the Chief Syariah Prosecutor personally.
