PART III - MARRIAGE AND REGISTRATION



Section 10. Application and permission of marriage.

(1) The Registrar shall not solemnise a marriage unless he has received an application from both parties to the intended marriage in Form 3A and Form 3B respectively of the Fifth Schedule and such forms shall have been received by the Registrar not less than seven days before the date of the intended marriage unless the marriage has to take place immediately due to special and unavoidable reasons which are considered reasonable by a Qadhi.

(2) No marriage shall be solemnised unless a permission in Form 3c has been issued by the Chief Registrar of the Registrar concerned to the parties to the marriage.

(3) The Registrar shall not solemnise a marriage where any of the parties is from outside the State, unless written permission has been obtained from the Qadhi of the place where such person normally resides:

Provided that if there is no Qadhi in such place the permission shall be obtained from the person in authority in the place.
