PART IV - SYARIAH COURTS
Section 41. Appointment of Syariah Judges.
(1) Duli Yang Maha Mulia Sultan shall, after consultation with the Majlis, appoint the Chief Syariah Judge and the Judges of the Syariah HIgh Court.
(2) For the purpose of appointing a Syariah High Court Judge the Majlis shall consider the recommendation or views of the Chief Syariah Judge.
(3) (a) A person is fit for appointment under subsection (1) if he is a male citizen who has for not less than ten years preceding his appointment served as a member of a Syariah Court.
(b) For the purpose of paragraph (a) a person who, before the commencement of this Enactment, has served as a Kadhi or Syaraih Court Prosecutor shall be deemed to be a member of a Syariah Court.
(4) Notwithstanding the provisions of subsection (3) any male citizen who specialises in the field of Islamic law may be appointed under subsection (1) for a period and on terms to be determined by the Majlis.
(5) All appointments under this section shall be notified in the Gazette.
