(1) Except as provided otherwise in this Enactment, a person who has attained the age of baligh, of sound mind, is not declared a bankrupt and on his own free will, may surrender
his property as a wakaf for any charitable purposes according to Hukum Syarak.
(2) A wakaf may be created either as wakaf am or wakaf khas.
(3) A wakaf shall be created by way of sighah before not less than two witnesses in accordance with Hukum Syarak.
