ENACTMENT NO. 12 OF 1986 ADMINISTRATION OF ISLAMIC RELIGIOUS AFFAIRS ENACTMENT 1986
PART II - APPOINTMENT OF OFFICERS AND ESTABLISHMENT OF THE MAJLIS
Section 5. Establishment of the Majlis and use of the seal.
(1) His Royal Highness the Sultan hereby constitutes a Majlis Agama Islam dan Adat Melayu to aid and advise His Royal Highness the Sultan in all matters relating to Islamic religious affairs and the Malay custom generally. The Majlis shall consist of -
(a) a President;
(b) the Mufti; and
(c) not less than seven other members two-thirds of whom shall be persons having knowledge in the field of the Religion of Islam,
and all the members of the Majlis shall be appointed by His Royal Highness the Sultan.
(2) The Secretary to the Department shall be the secretary of the Majlis.
(3) The Majlis is a corporation with perpetual succession and having a common seal which may from time to time be broken, changed, altered, and made anew as the Majlis thinks fit, and until a seal is provided, a stamp bearing the inscription "Majlis Agama Islam dan Adat Melayu, Terengganu" may be used as the seal of the Majlis.
(4) The Majlis may sue and be sued in the name of Majlis Agama Islam dan Adat Melayu, Terengganu, and may for all purposes be described by that name.
(5) The seal of the Majlis shall not be used except with the permission of the Majlis, and every instrument requiring the seal of the Majlis shall be sealed with such seal in the presence of the President and a member of the Majlis, each of whom shall sign the instrument, and such signing shall be sufficient evidence that the seal was duly and properly affixed as authorized by the Majlis.
(6) The following documents shall be executed using the seal of the Majlis, that is to say-
(a) documents required by any written law to be under seal;
(b) letters of appointment or authority to all officers of the Majlis;
(c) letters of appointment or authority to any person to carry out any specific act on behalf of the Majlis; and
(d) such other documents as His Royal Highness the Sultan may from time to time direct to be under seal.
