Section 44. Construction of instruments creating or affecting wakaf
(1) If the Majlis is in the opinion that, the meaning or interpretation or effect of any instruments or declaration creating or affecting any wakaf is ambiguous or uncertain, the Majlis may refer the instrument or declaration to the Court for its decision as to the meaning, interpretation or effect thereof and the Majlis shall act on any order given by the Court.
(2) For the purpose of this section, Court includes civil courts established under Article 121 of the Federal Constitution.
