ENACTMENT NO. 1 OF 1983 ISLAMIC FAMILY LAW ENACTMENT 1983
PART VIII - GENERAL
Section 115. Recognition of Muslim marriage contracted outside Malaysia.
A Muslim marriage contracted outside Malaysia other than a marriage under section 24, and a marriage solemnised in a Malaysian Embassy, High Commission or Consulate under the provisions of section 20, shall be recognised as valid for purposes of this Enactment if-
(a) the marriage was contracted in a form required or permitted by the law of the country where it was contracted;
(b) each of the parties had, at the time of the marriage, capacity to marry under the law of the country of his or her residence; and
(c) where either of the parties is domiciled or temporarily resident in the State, both parties had capacity to marry according to this Enactment.
