General Provisions



Section 63. Inheritance certificates.

(1) In the course of any proceedings relating to the administration or distribution of the estate of a deceased person who professed the Religion of Islam any civil court which is under a duty to determine the persons entitled to share in the estate or the shares to which such persons are respectively entitled may request Chief Qadi or the Depurty Chief Qadi to certify upon the facts submitted yy that Court his opinion as to the persons who are entitled to share in the estate and the shares to which they are entitled.

(2) The Chief Qadi or the Deputy Chief Qadi may, on the application of a person claiming to be a benefici­ry and on payment by him of the prescribed fee, similarly certify his opinion upon facts submitted and may in any case, before certifying his opinion, require to hear the parties on any questibn of law, but shall not hear evidence or make findings on any question of fact.

(3) In any case of splciaI difficulty the Chief Qadi or Deputy Chief Qadi may refer the question to the Mufti for his opinion, and shall, if the Mufti gives his opinion, certify in accordance therewith.
