(1) Where the Court is satisfied that on Hukum Syara', that the eVIdence of any party or wItness should be taken before the hearing date, the Court may order another Court or any Judge to take the evidence of any party or witness and the evidence so taken may be used at the trial.
(2) Notice that the evidence will be taken under subsection (1) shall be served to the other party not less than 2 days before the date the evidence is to be taken and the other party may take part in the said proceedings.
