PART XXII - JUDGMENT DEBTOR SUMMONS, WARRANT OF ARREST, ECT.



Section 169. Deposit before order of committal.

(1) Before any order of Committal is executed the judgment creditor shall deposit with the bailiff a sum sufficient to provide for the subsistence of the judgment debtor for a period of fourteen days, or for the period of imprisonment if less than fourteen days, at such rate as may be fixed by the Court.

(2) Where the judgement debtor is liable to be detained in prison for a period exceeding fourteen days the judgment creditor shall, at or before the end of the first fourteen days, deposit with the bailiff a futher sum as aforesaid to provide for the subsistence of the judgment debtor for the next ensuing fourteen days, shall continue to make such deposit in advance at or before the end of each successive period of fourteen days, so long as the judgment debtor is detained in prison.

(3) A person so imprisoned shall be released forthwith upon payment of the amount stated in the Warrant of Committal. An order of release shall be in Form 25.
