Section 97. Recognition of marriage solemnized outside Malaysia.

(1) A marriage of a Muslim solemnized outside Malaysia other than a marriage solemnized at any Embassy, High Commission or Malaysian Consulate under the provisions of section 18 shall be recognised as valid and as a marriage registered under this Enactment if-

(a) the marriage was solemnized according to the procedure required or allowed by the

lex loci celebrationis;

(b) each party has the capacity at the time of marriage to contract the marriage according to his

lex domicilii

; and

(c) one of the party is a domicil or resident of not less than four months in this State and both parties have the capacity to contract a marriage under this Enactment.

(2) Notwithstanding the provisions of sub-section (1), a marriage of a Muslim so solemnized above shall not be registered under this Enactment if the marriage is in contravention of the provisions of section 17.
