Section 38. Appeal allowed in certain cases.

The Syar'iah High Court may, on the application of any person who wishes to appeal but is debarred from so doing by reason of his not having complied with any requirement of this Enactment, permit an appeal on such terms and with such directions to the Court appealed from and to the parties concerned as the Syar'iah High Court considers necessary in order that justice may be done in the matter.
