ENACTMENT NO. 2 OF 1992 ADMINISTRATION OF ISLAMIC LAW ENACTMENT 1992
PART IV - SYARIAH COURTS
Section 53. Transition for Court and Judges.
(1) On the coming into force of this Enactment the Court of Kadhi Besar or the Courts of a Kadhi shall be known as and deemed to be the Syariah High Court and the Syariah Subordinate Courts, as the case may be, constituted under section 40 and all proceedings pending in the said Courts shall continue and be deemed to have been proceeded with under this Enactment.
(2) Any person who, immediately before the commencement of this Enactment was holding the appointment of Kadhi Besar or was appointed to exercise the duties and powers of Kadhi Besar shall, on the commencement of this Enactment, hold office as a Syariah High Court Judge as if he had been appointed under section 41.
(3) Any person who immediately before the commencement of this Enactment was holding the appointment of Kadhi shall on the commencement of this Enactment hold office as a Syariah Subordinate Court Judge as if the had been appointed under section 42.
